This Privacy Notice (“Notice”) describes how Skyworks LLC and its subsidiaries (collectively, “Skyworks”), collect, use, share, retain, transfer and otherwise process information relating to identified or identifiable individuals (Personal Information), and the rights you may have regarding your Personal Information. “California Information” means all Personal Information that relates to residents of California and that is covered by the California Consumer Privacy Act or the California Online Privacy Protection Act, including any amendments thereto, (collectively, the “California Laws”).
“Collected Data” means all (i) Personal Information and (ii) Non-Personal Information that is obtained from you through this website or otherwise in the ordinary course of Skyworks’ business.
“Non-Personal Information” means all information that is not Personal Information (including, but not limited to, any Analytical Data) and that is electronically collected by Skyworks through the website and e-mail messages and other electronic communications sent by you to Skyworks.
“Personal Information” means all information collected by Skyworks, electronically or manually, through (i) the website, (ii) e-mail messages and other electronic communications that you may send to Skyworks, and (iii) other sources in the ordinary course of Skyworks’ business, that relates to an individual or household and that identifies, or can be used in conjunction with other readily-accessible information to identify, such individual or household (including, but not limited to, such individual’s name, e-mail, address and phone number).
HOW AND WHAT PERSONAL INFORMATION WE COLLECT
All Collected Data, including Personal Information, obtained from you is provided by you (or by a third party on your behalf) voluntarily, except for any Analytical Data obtained automatically through the website as set forth in this Notice. Whether or not you have previously sent Skyworks an e-mail message, you consent to Skyworks’ sending you e-mail messages and other electronic communications (a) in connection with your use of the website, or (b) for any other legitimate business purpose of Skyworks (including, but not limited to, marketing). ANALYTICAL DATA AND TARGETED ADVERTISING
This website utilizes essential cookies to save your website preferences and nonessential cookies to collect Analytical Data and for marketing purposes as described below. Skyworks also uses third parties to improve our ability to identify visitors to the website. As part of this service, we may share available identifiers with these third parties including our visitors’ IP addresses, cookies, and hashed versions of email addresses captured from your visit. We, and third parties, use this data to obtain more information about our visitors and reach out to them through other channels. In the case of internet ads, these third parties may combine and use data collected through your use of the website with data they collect over time and across different websites for their own purposes. Skyworks may also at any time, in its sole discretion, transfer any Collected Data, whether or not you furnished such Collected Data for a specific purpose, to (a) comply with, or as permitted by, any applicable law or lawful request of a government or public authority for purposes of satisfying national security, law enforcement and other similar requirements, (b) cooperate with law enforcement, and other third parties, in investigating a claim of fraud, illegal activity or infringement of intellectual property rights, (c) protect the rights, property or legitimate business interests of Skyworks or a third party, or (d) transfer such Collected Data to a third party acquiring all, or substantially all, of the assets of Skyworks. If Collected Data is transferred to a third party pursuant to this paragraph, Skyworks will have no responsibility for any use of such Collected Data, or any action of, the third party to whom or which such Collected Data is transferred or for the failure of such third party to protect such Collected Data. USERS FROM OTHER JURISDICTIONS
The website and business operations are controlled and operated by Skyworks from the United States. If you choose to use the website or provide information to us, please note that your Personal Information may be processed in the United States. The United States does not have an adequacy decision from the European Union, which is a formal acknowledgement from the AU that another country provides an equivalent level of protection for Personal Information as the EU does.
By providing Personal Information to Skyworks for the purpose of using or inquiring about our products and services, you consent to the transfer of Personal Information to the United States. The transfer of that Personal Information to the United States is necessary for Skyworks to provide requested information and services. PAYMENT PROCESSING
Skyworks uses Authorize.net to process payments made by customers for products and services. We do not collect, process or retain payment information. However, Skyworks ensures that obligations substantially no less protective than those set out in this Privacy Notice are imposed on our third party vendor by way of contract or other legally binding agreement, in particular providing sufficient guarantees that technical and organizational measures are implemented in such a manner to meet the requirements of this Privacy Notice and the relevant data protection laws. Skyworks strives to comply with all applicable cybersecurity and data protection laws. Except as provided in the immediately following sentence, Skyworks will use commercially reasonable efforts to protect Personal Information from loss, misuse, unauthorized access, alteration, destruction, and disclosure. Certain Personal Information posted by you on the website may be accessible to the general public, and Skyworks is not responsible for protecting such Personal Information from loss, misuse, unauthorized access, alteration, destruction, or disclosure. Skyworks does not sell California Information. Skyworks does not discriminate against a California resident for exercising any right of such resident under the California Laws, except as permitted under the California Laws.
CHILDREN
The website is not directed to, or intended for, children under 13 years of age. However, if a parent or guardian of a child who is under 13 years of age discovers that Personal Information of such child has been submitted to Skyworks through the website without the parent’s or guardian’s consent, Skyworks will use commercially reasonable measures to remove such Personal Information from Skyworks’ servers at the parent’s or guardian’s request. To request the removal of such Personal Information, the parent or guardian must contact us as set forth in Contact Information Section, and provide all information requested by Skyworks to assist it in identifying the Personal Information to be removed.
RETENTION OF PERSONAL INFORMATION
Skyworks’ products and services are complex, and thus our retention periods for Personal Information vary. We consider the following obligations when setting retention periods for Personal Information and the records we maintain:

APPLICABLE LAW
This Notice shall be governed by, and construed and interpreted in accordance with, (a) in in the case of California Information, and solely to the extent required by the California Laws, the California Laws, (b) any other applicable privacy law solely to the extent required by such law, and (c) in all other cases, the laws of New York, without regard to its principles of conflict of laws.
COMPLAINTS
Any complaint by you regarding any Collected Data, or otherwise relating to this Notice, must first be submitted to Skyworks as set forth in the contact information section, and Skyworks must be given a reasonable opportunity of not less than 30 days to investigate and respond to your complaint. Upon Skyworks’ completing such investigation and so responding, Skyworks and you must then attempt, in good faith, to promptly resolve any remaining aspects of your complaint. If any aspect of your complaint remains unresolved after an additional reasonable period of not less than 30 days, the dispute must be resolved in accordance with the dispute resolution procedures contained in Skyworks’ Terms Of Use.
ENTIRE AGREEMENT
This Notice contains the entire agreement, and supersedes all prior oral and written agreements, proposals and understandings, between you and Skyworks, with respect to Collected Data.
SEVERABILITY
Whenever possible, each provision of this Notice shall be interpreted to be effective and valid under applicable law. If, however, any such provision shall be prohibited by or invalid under such law, it shall be deemed modified to conform to the minimum requirements of such law, or if for any reason it is not so modified, it shall be prohibited or invalid only to the extent of such prohibition or invalidity without the remainder of such provision, or any other provision of this Notice, being prohibited or invalid.
REVISIONS
Skyworks may revise any provision of this Notice from time to time by posting the revised provision on the website so long as such revision does not conflict with any applicable law. Any such revision will take effect immediately upon such posting, and will apply to all Collected Data obtained by Skyworks after such posting. It is your responsibility to periodically check for revisions to this Notice on the website. The latest version of this Notice will always be the one posted on the website.
EXPENSES
Except as provided in this Notice or by any applicable law, you are solely responsible for all fees and disbursements of any attorney or other advisor retained by you in connection with enforcing your rights under this Notice.
